Is it legal for my users to upload music?

I installed SE music plugin and users have been uploading some of their favourite songs and music. I don't know whether those they uploaded are legit. Even if they bought those tracks, i wonder whether the uploading process to share with their friends is OK.

That's not a solution, as you are not only playing the music publicly you are also making a copy when its uploaded to the server, plus that licence only covers Germany.
Many countries have this kind of licence policy ie such as the UK which is PRS & PPL, ...  more

Yes it's illegal. It's making an unlawful copy. Check the DMCA and the Copyright Act - which have no such provisions. When you purchase a CD or music file, you do not acquire the rights to public performance of that song...check the license agreement under which your purchase was made.

If that''s the case why is SocialEngine selling their music plugin? I always thought if there is no download button, it's fine. Many of my users (primary teens and young adults) are happy to post a few songs of your likings and get them to show up on thei...  more

Not sure but this is has been widely debated on the internet regards sharing, SE will sell anything they can make a profit on, and they can sell it. Even if the music plugin does not have a download button, I could quite easily download the track off your...  more

That's an interesting question! The answer is no, but it may depends. Especially on location of your hosting server. Laws aren't the same in all countries. For example in some countries you can get your user agreement organized the way your users will be responsible for any content they upload. Again I'm not a layer, you need to get some legal advice here.
